H1B 6Yrs Cycle will Restart ?

Hello Guys

In my total 6 yrs H1B...I have used 3 yrs (US) and after 2 yrs stay in India if i came back to US ...will my 6yrs cycle will reset ?

You have the option to take the remainder time (clock would not reset) or an employer can file a new H1 in next year's quota with clock reset.

The rule is: for the clock to reset the person has to be outside the US for at least a year AND THEN a new H1 in the quota is filed.

You can recapture any time you spend outside of the US when you file for your future extensions. Thing to note: on any given petition you can request maximum of 3 years approval.

Your cycle will reset when you get new H1B approval in lottery. Your question will not lead to cycle reset.

I believe your cycle will reset after a total of 6 years on H1b.   Is there a way your employer can start your PERM process and get you an I-140?

No. To get another full 6 years you have to go through lottery again (New petition).
