My husband's office will be applying for extension, as the max out date on his h1 visa is on nov 2014.meanwhile I have received admission for Masters program for fall 2013,and wish to transfer from h4 to f1 visa. My questions areShould I wait for h4 extension application, or can directly apply for my f1 transfer? Since it takes time for the transfer to come, will I still be eligible to stay here and start my studies?

Yes, you will be eligible to stay because you filed your change of status before your current status expires, But not sure you can start your studies because school needs an unexpired I 94 when u start ur studies.

pontevecchio Posted June 17, 2013 Report Posted June 17, 2013 @gauri Have your H4 extension done and then process your COS to F1. Your F1 status can only kick in up to 30 days before the start date. That means you need previous status at the time the COS to F1 kicks in and you do not seem to have that. When do the classes start in Fall?
gaurisharma Posted June 18, 2013 Author Report Posted June 18, 2013 @pontevecchio classes start in last week of august..with the h4 extension now, pushes my F1 extension further off, and not letting me try for assistantship for Fall 2013.. any further advice?
pontevecchio Posted June 18, 2013 Report Posted June 18, 2013 Based on the classes starting in the last week of August and since one can be in F1 status up to a month before classes start you should go ahead and file your COS from H4 to F1 .
tan26809 Posted June 19, 2013 Report Posted June 19, 2013 I have a query , my husband has changed his job few months before , however I have not yet transferred my H4 to new employer . Now , I have to apply for COS to F1 , my query is should I get my H4 transferred to new employer prior to COS , or I can directly file for COS to F1 ?. Note :- My and mine husband visa is valid for another year.
pontevecchio Posted June 19, 2013 Report Posted June 19, 2013 H4 has no connection to the employer. That should answer your question. Go ahead and apply for the COS.
