Thanks for taking time to go through this.

There was an error in work location while filing my LCA and H1b. Now my employer is applying for amendment and I am planning to visit India soon. I am not sure if I will have my new I797 copy with me by the time I leave US. But my employer will send me the original copy of I797 once they receive it from USCIS. They are applying in premium processing and I should have decision before I leave.

My question is, can I leave US before I get my I797 copy? I already have my old I797, I94 which was approved for 3 years. Can I travel with old I94 and go for stamping once I receive my new I797?

Unless it is a full-time job, don't take the risk of going to India for stamping, it is very uncertain once you go there

As per my travelling experience, when you leave US I guess they will not ask about H1. They will just take away your i94 thats all I guess. But this is just my personal view.
