Went to india and came back on old stamping and during Poe officer dint asked my new i797 so gave just passport , he gave entry based on old petition as we came before expiry Of old petition, now my old I94 and visa expired , can I stay with physical i797 extended copy which is valid till 2025 which is approaved in Feb 2023 before our travel Quote Link to comment

Zodiac System Posted February 23 Report Share Posted February 23 Get in touch with an immigration attorney immediately. You have to go by the "latest" I-94 date and in your case the latest I-94 is the one you received at the POE, immigrations. You may have to leave the country, get new visa stamping and then enter back OR file for another H1b extension "nun pro tunc". Good Luck. Quote Link to comment
