rajib01
In my case, I may potentially face this situation. My employer will file I-140 and I-485 concurrently (my PD is current). However there is a chance my current I-94 (on E2 status) will expire after a week of that filing. My question is, Can I stay in the US legally after the I-94 is expired even my I-140 is pending at that time? After concurrent filing do you get two different case tracking number (one for I-140, one for I485) or just one? Will both of the case be in Pending status initially? Quote Link to comment
newacct
Yes, you can stay in the US while your I-485 is pending. Quote Link to comment
pontevecchio
Once your AOS is on file, you are legal to stay. For specific guidance talk to your HR/Immigration Lawyer. Quote Link to comment
