RKrish123
Hi I did my Masters and My H1B petition was approved in 2009 (2009~2012). However I didn't get my H1 visa stamped(that was in jul 2011). Now, I’m planning to try H1B again.is my case eligible for cap exemption? (or) do i need to file petition for next year ..? Cupeed
This will go under Cap exempt and the employer will have to file a transfer petition(cap exempt). Quote Link to comment
Zodiac System
Try both options. If an employer is willing to process a transfer with your previous H1b, let him do it. Some have found success. Good Luck. Quote Link to comment

pontevecchio
Unless you got a H1 Visa stamp or worked for the initial sponsor, you will need to go through the lottery. Quote Link to comment
