I got another role to transfer my H1, but its a part time H1 at this point. I have an expired B2 on my passport, so am wondering, since my 60 days expires this week, can i also apply for a B2? The H1 response will not come for a few months, but if there is an RFE or rejection, the B2 visa will help if it gets approved, so I can be in status right? Anyone tried this and encountered issues with USCIS questioning these two applications together? Do they not cross and compare notes that both visas have been applied for? My fear is that the B2 application will harm my H1B transfer. The company is a smaller one, so I want a backup... Thanks for reading! Quote Link to comment
newacct Posted August 26, 2022 Report Share Posted August 26, 2022 If an H1b extension is filed for you before your grace period ends, you can stay in the US while it is pending. If it is denied, you just leave. I don't see a point to filing for Change of Status to B2. Quote Link to comment
