h1b Cap exempt after 5 yrs of stay in india

HI 

I got my h1 in 2013 , i spent around 3yrs from 2014-2017 in usa and come back to india for-good

Now my things are settled and planning to utilize remianing 3yrs on my first petition

i am aware the petition will be revoked after i quit my employer , but it is valid for cap-exempt

 

since its more than 5yrs  am out of usa , am i eligible to re-apply ( if i get an employer) and also plz confirm if the duration in india for more than 6yrs,the petition cant be used again and it permenanly useless

Yes, you are eligible if you have an employer willing to process the remaining years of your H1b.  Good Luck!

Once cap counted and in H1 status, you are eligible for a total of 6 years in H1 status over any period of time.
