June 2021 Posted June 3, 2021 Report Share Posted June 3, 2021 Hi I am currently having H1b (with I140 approved in sept 2019) . I am currently in India. My husband is also having H1B and he is also in India. He is planning to travel to USA. We both have H1b for different work locations. therefore i am planning to convert H1b to H4 so that we can be at same location in USA. What if i find a new job at my husbnad's location, can i file H4 to H1 (change of status) based on my previous H1 and approved I140? or my i140 will be expired or invalid once i go on H4 ? Please help. Also, will change in employer affect my case in any way? Quote Link to comment

Zodiac System Posted June 3, 2021 Report Share Posted June 3, 2021 In your new location, when you get a job, you should be able to file H4 to H1 change of status based on your previous H1 and I140. Your I140 will not expire or become invalid. Change of employer should not affect your case. Quote Link to comment
