MyH1BTransfer
Hi, Below is my situation: I am working for company A and my i-94 expired in Feb 2020. My H1B extension with my current employer is in progress. I got an offer from company B. I would like to know 1. If transfer petition is filed for company B, does transfer approval depends on my current H1B extension approval? 2. what happens if h1b extension which is in progress gets denied before transfer approval? 3. Is the petition filed by company B a bridge petition? how does it impacts my current situation? 4. what happens if company B transfer gets approved while extension is in progess, will i get i-94 along with i797? Thanks! Quote Link to comment
pontevecchio
Once the I94 expired it becomes a bridge petition. You can always leave and return with the visa. Quote Link to comment
User099
Emp B can do Bridge or a consular processing petition. Bridge petition will depend on the approval of Emp A's petition. Consular processing petition will be best if you are not sure if the Emp A's petition will be approved or not. Consular processing petition means once approved you will have to leave the country and come back with a new visa and new I94. Quote Link to comment
gopalakrishnach
1. Yes since your I94 expired. First they wait for Emp A petition decision. Quote Link to comment
AmericanDream2020
What did you do eventually? Go for consular processing? Or wait for Employer A's approval? Quote Link to comment
