H1B Transfer

Hi,

My Employer Filed H1B based on Approved I140( I got Approved I140 in may 2019).  I received RFE on H1B Application. 

Currently my employer is Preparing documentation for RFE Submission. In between I got one new Job opportunity with Employer B.

In this Situation Can I switch to new Employer B? 

Will there be any Impact on my PD and I140 by Switching to new employer B?

If you current employer revokes your I140, you will not be able to retain the PD. To retain the PD, I140 need to be valid for 180 days atleast.

You said you got Approved I140 in may 2019. Employer has right to revoke I140 before 180 days. After that they cannot. In your case if you move to new employer I feel your current employer will revoked approved H1B ( by law) and also I140. Think about it.

I think you are good to start the process with your new employer B... By the time your employer realizes, you would have crossed that 180-day mark.
