VinMani Posted October 30, 2019 Report Share Posted October 30, 2019 Hi, My Employer Filed H1B based on Approved I140( I got Approved I140 in may 2019). I received RFE on H1B Application. Currently my employer is Preparing documentation for RFE Submission. In between I got one new Job opportunity with Employer B. In this Situation Can I switch to new Employer B? User099 Posted October 31, 2019 Report Share Posted October 31, 2019 If you current employer revokes your I140, you will not be able to retain the PD. To retain the PD, I140 need to be valid for 180 days atleast. Quote Link to comment

After that they cannot. In your case if you move to new employer I feel your current employer will revoked approved H1B ( by law) and also I140. Think about it.
