I read on lot of forums about using future date as option for COS to have minimal employment gap . Below are my concerns . 1) Can we file H1 to H4 EAD with future date as start date 2) Does both the application gets approved at the same time? 3) What in general processing time ? The future start date is not so important. USCIS does not consider that field. Happened to my spouse. I put in a future date but USCIS gave a start date the day they approved the applications. 2. In my case both applications (I-539 and I-765) got approved on same day. 3. It took 2 months for my case. Anywhere between 2 to 4 months. Make sure you file both the applications together.
