sam2018 Posted September 24, 2020 Report Share Posted September 24, 2020 Hello All, A little BG on my case: I came to the USA on H1-B and started my GC process, my I-140 got approved and later on, I moved to H4 status as I got laid off, now I have H4 EAD and currently unemployed. My PD is current on EB-3. Am not sure how to take my I - 485 forward. Do I have to be on H1 status to file my 485 or can I file my I-485 with my current H4 status? What all options do I have and how soon should I have to ACT. Thanks In Advance. Quote Link to comment

Do I have to be on H1 status to file my 485 --- only employer can apply for 485. Now I guess you need to find H1B and get I140 approved. You can port PD. Quote Link to comment
