ramid Posted May 18, 2016 Report Share Posted May 18, 2016 Hello Experts, my Perm and I140 Approved with "Employer X", now can "Employer Y" file H1B extension based on my previous Employer's Perm,if I140 is withdrawn from my Previous "Employer X". my H1B will expire on Oct2016, can my new employer file H1B extension based on my PERM approved with my previous employer? pontevecchio Posted May 19, 2016 Report Share Posted May 19, 2016 PERM approval does not give you H1 extensions. Approved I-140 gives you extensions and the extension stands even were the I-140 to be SUBSEQUENTLY revoked. Link to comment
rohang Posted May 19, 2016 Report Share Posted May 19, 2016 PERM doesnt matter in this case, as PERM has validity of 6 months. If I140 has been revoked, you can't use it as basis of extension. Link to comment
