Question on H1B cap exemption

Hi,

 

One of the employers filed a H1B for me in 2008, when I was in India. I have never collected my petition, never work on that visa, but I have the receipt number. 

 

I came to USA through another employer in Dec, 2013 on L1B visa and working in USA since then. Now if my current employer want to file a H1B for me, can I get a cap exemption based on my 2008 H1B petition?

 

Please advise.
