H1B Transfer

Hi,

 

I am currently working full time on H1B. I got a new job offer and will be joining the new company in June or so (start date is flexible and can join in July too). I would like to resign my current job as soon as possible and take a 1 month break to go to India. I am assuming if I initiate my H1B transfer now then I cannot travel to India - is this right ?

 

Any thoughts on how I can make the India trip and get the H1B transfer for the new company completed by June/July? Can I resign my current job, go to India, and then ask the new company to process my H1B application?

You are incorrect. Have the new company file your H1 petition in PP and you can return with an existing H1 visa and this approval.

I have H1b visa valid till 2017 with employer A. I came back to India in October 2015 and transferred my visa to employer B. 

Do I need to go for stamping again or can I travel with same visa stamping with new I797.

You should be able to use the existing visa and the latest H1 approval to come and work for this H1 sponsor.

You can come back with the valid H1 visa and a copy of the new H1 approval notice from employer B.
