H1B extensions after I-140 is revoked by previous employer ( non-fraud category)

Hi,

 

Below is my scenario:

 

- I have completed 6 years on my H1B and have approved I-140 with company A.

- Company B has filed for H1B transfer and got 1 year approval from Feb 2016 to Feb 2017.

 

My question is

 

- If Company A revokes my I-140 ( non-fraud category) then can Company B still file for H1B extention in Feb 2017 ?

 

Company B attorney is saying that they can still continue to file for extensions even if I-140 has been revoked by Company A if it is not a fraud case.

I am in exact same situation as you are.., I have an approved i140 but NO i485 filed.. I am planning to make a switch as well.I am getting 2 years extension on H1 transfer.. I will be completing 6 years on h1 in 2017 December..

 

My employer says he will withdraw the i140 the next day i leave..

 

Not sure should i make the jump/switch?

Why not push the new company to file for three years in total instead of one.? Irrespective of misleading information all over the place , once the I-140 is revoked further extensions beyond the initial 6 are NOT possible. All sorts of rules are being proposed. None of them is still active.
