welcome2usa Posted March 29, 2016 Report Share Posted March 29, 2016 Hi, Below is my scenario: - I have completed 6 years on my H1B and have approved I-140 with company A. - Company B has filed for H1B transfer and got 1 year approval from Feb 2016 to Feb 2017. My question is - If Company A revokes my I-140 ( non-fraud category) then can Company B still file for H1B extention in Feb 2017 ? Company B attorney is saying that they can still continue to file for extensions even if I-140 has been revoked by Company A if it is not a fraud case. Thanks in advance! Link to comment
confused_hustler007 Posted April 24, 2016 Report Share Posted April 24, 2016 I am in exact same situation as you are.., I have an approved i140 but NO i485 filed.. I am planning to make a switch as well.I am getting 2 years extension on H1 transfer.. I will be completing 6 years on h1 in 2017 December.. My employer says he will withdraw the i140 the next day i leave.. Not sure should i make the jump/switch? Link to comment
pontevecchio Posted April 24, 2016 Report Share Posted April 24, 2016 Why not push the new company to file for three years in total instead of one.? Irrespective of misleading information all over the place , once the I-140 is revoked further extensions beyond the initial 6 are NOT possible. All sorts of rules are being proposed.
