harishreddi12 Posted March 8, 2016 Report Share Posted March 8, 2016 Hi Friends, Need help with the below I am on H1B and my wife is on H4. Recently i lost the job on Jan 21nd 2016 with a company A and they have sent the revocation letter to USCIS that Jan 21st 2016 is my last working day with company A and USCIS website shows that on Feb 25th my H1b is revoked and I did my H1b transfer to company B on Feb 22nd and I didn't file an H4 transfer with new employer since my wife got an offer with an MNC company and they filed her H4 to H1b on Jan 19th 2016 with USCIS. Unfortunately my wife's H1b was denied on March 3rd 2016 and we don't know the reason yet. ( I am thinking my H1b revoke might be the reason ). Initially they gave an RFE asking for client letter and SOW and they did submit these. My question here is do I need to file immediately an H4 with the new company for my wife since my previous H1b is revoked ? Her previous H4 with company A is valid till Oct 2016. Another question is if I file her a new H1b then the old H4 should be good enough ? Please let me know if you need further info. Link to comment

JoeF Posted March 8, 2016 Report Share Posted March 8, 2016 An H4 is employer-independent. There is no such thing as an H4 transfer. Her old H4 continues to be valid (up to the printed expiration date) as long as you are in valid H1 status. Link to comment
