L1B to H4 COS

Hello experts,

 

I have applied for my L1B extension and have recieved an RFE and in the process of responding to the RFE. My I94 and visa has already expired.

 

My spouse is on H1B. In case my L1B extension gets denied, 

1. can i apply for COS to H4 and continue to stay in US. 

2. If not, how soon can i apply for H4 visa after going back to my home country and then return to US? 

3. Will my L1B denial create any problem with my H4 visa?

1) COS is valid if your previous status is valid, which might not be true if you visa is denied.

2) this can be done immediately, and this is a better option.

3) no impact.

Can I go to Canada for H4 stamping? is that an option at all?

Can i book my appointment for H4 visa interview while i am here in US or do i have to go to my home country and then book the appointment?

You can book from anywhere. Go back and return with a H4 visa. If the H1 is credible there is no problem.
