Below is the scenario: Let's say, my husband is working for company X and got his PERM started with company Y and got an I-140 approved with company Y. 1) Can I apply for EAD based on that I-140, though he continues to work for company X? 2) Can he give the receipt of the approved I-140 to company X and ask them to continue the process from there? 3) Do we need any documents from the current employer(X) if we are filing with the other employer(Y)? FYI- My husband is on H1B and I am on H4. Can someone please respond to these questions as early as possible. Thanks Divya Link to comment

So, in that case, once company X starts our PERM process, would they be able to use the same priority date ( assuming that we have received the I-40 from company Y)? Do we need any documents from the current employer(X) if we are filing with the other employer(Y)? Like experience letter, employee verification letter etc. Link to comment
