sat_adt
Hello All, Greetings !!. Am holding L1B Visa and visa expires on Nov 2016. My employer filing H1B with Change of Status this year. But due to health issue am traveling outside of US by Mid of February and back to US on First week of April. In this case my employer want to file as Consular Notification as I will not available during H1B filing. My question is, Is there any chance of rejection my H1B case when filing consular notification instead of Change of Status. If yes, what is the earlier date I should be back to US before filing. It is bit urgent and expecting your reply. Appreciate your help. Link to comment
pontevecchio
There is no chance of rejection because you travelled during the process. It means AOS is not possible in any case. Link to comment
