sunny1313 Posted August 22, 2011 Report Share Posted August 22, 2011 Hi All, I am currently in USA on L1B visa and my wife is on L2. I recently got an H1B approval. I was thinking of applying for H1B for my wife also as a premium case. So I have few questions around this 1. If her H1 is rejected after Oct 1 (when my H1 becomes active), can I then apply for H4. 2. If her H1 is rejected on lets say 15th Oct, and then immediately I apply for her H4, will her status be considered as illegal status from Oct 1 - Oct 15. 3. Can I apply for H4 and H1 simultaneously, if yes if both are approved what would take precedence. 4. Shall I first get H4 and then H1. Link to comment

pontevecchio Posted August 24, 2011 Report Share Posted August 24, 2011 She needs to file her COS from L2 to H4 so that she is allowed to stay till they decide. If she finds a H1 sponsor she can leave and get the visa and come back if the H1 petition is approved. Link to comment
