I want to start working with employer B. Can my H1-B receipt obtained from employer A be transfered to employer B or Does employer B need to separately file my H1-B? Please let me know the procedure. jairichi Posted November 25, 2015 Report Share Posted November 25, 2015 If this is a cap subject H1B petition filed by A then you need to work for A after approval before a transfer can be initiated. If this a cap exempt petition (i.e. you were cap subject earlier) new employer has to file a cap exempt H1B petition & you can work after approval. Link to comment

Since H1-B is not transfered in premium process, I am still awaiting approval as a part of regular process. You may need to wait until the current one gets approved unless you have a current petition that B can try to transfer again. Check with an immigration attorney as every case is different.
