My Wife's travel back to the US with an about to expire Visa and renewed H4

Hello All: 

 

Need inputs from y'all in the situation we are in.

 

My Wife's VISA is set to expire on December 29 2015. She is in India right now and is planning to return to the US on December 24 2015. She also has a renewed H4 petition that is valid till December 29 2017. My questions are below:

 

1.) Can she travel back to the US without any hassles at the POE as the visa end date is less than a week away?

 

2.) She also has a H4 EAD, can she use that as a trump card for traveling back? If so, what other documentation does she require to go along with the H4 EAD?  

 

Please let me know.

The only specific document she needs to return is your H1 petition approval besides her passport and H4 visa. She can enter any time before the visa expires.

1. She needs a copy of your I797.

2. EAD is of no use here. Refer 1.

1.Yes she can, but its better to the visa renewed

2. EAD is useless at POE for H4 applicants, she need visa to enter into US.
