Poornimagaddam Posted October 22, 2015 Report Share Posted October 22, 2015 Hi, My husband's L1B and i94 has validity till March, 2018 but his i129s is valid only until April, 2016. I'm currently on L2 as a dependent of him and I have my L2, EAD both valid till March 2018. For both of us GC labor approved and I140 applied. couple of questions I have 1. Can we continue our stay in US after his i129S expires because his visa and I94 has validity till 2018? 2. If no, is there any other grace period we get as our PERM approved and I140 is applied? 3. Can we apply for H1B in 2016 Quota? Please help with some information. Link to comment

pontevecchio Posted October 29, 2015 Report Share Posted October 29, 2015 The I94 is controlling. You are able to stay till the I94 expiry assuming he continues to work for the L1 company. You can stay till 2018. You can try and find a H1 sponsor. Link to comment
Poornimagaddam Posted November 2, 2015 Author Report Share Posted November 2, 2015 Thanks for your response, that helps. just to be more clear on my question, Though his i94 and Visa is valid till 2018, he is maxing out April 2016 as he will complete 5yrs on current L1. rohang Posted March 6, 2016 Report Share Posted March 6, 2016 if max out date is april-2016, then even if you have I94 you cannot live. It will be considered out of status. max valid period supersedes i194. Link to comment
