Doubt regarding Passport validity for US re-entry.

Hi,

 

 

 

My current passport is expiring in March 2016. I am traveling to India in December and returning in January. 

 

 

 

Is it advisable that I get my passport renewed before I leave the country or are there no validity restrictions for re-entry into USA?

 

 

Also, I have a valid H1b visa stamped upto March 2016. If i get a new passport, do I need to go to stamping again?

No issue to enter US. But, your I94 expiry date will be your passport expiry date.

Since I94 will be till passport expiry when you return, please renew your passport as a matter of urgency. Valid visas in older passports remain valid. Carry both.

I-94 validity will be until expiry date of passport or  expiry date of H-1B (I-797) whichever is  earlier. It seems from your  post both these expire in the same month/year so it should not make any difference.
