My employer is planning to do my GC process under EB1-3 since i qualify for this category. During I-485 process, can my spouse travel outside US for few months (3+ months) and re-enter to US with valid visa? My spouse is having a valid visa for 2+years. pontevecchio Posted September 22, 2015 Report Share Posted September 22, 2015 Assuming a concurrent petition is filed asking for AOS and EAD and AP and assuming she gets the AP in hand she can travel after that. She can travel on her own H1 visa and you could file her AOS later on as EB1 is not going to be backlogged. Did you ask about your concern from the company Lawyer? Link to comment
