H1 to H4 transfer

Hello,

 

My wife ended her H1 job on 9/11/2015 and I wanted to know how much time do we have to file for her H4 visa. I want to know if she can stay in USA until we file for her H4 visa.

 

Please help and suggest.

She should have applied before the job ended. It is still early days and so she should apply for the COS today.

She should have filed a COS before her last working day with employer. File one immediately.

She needs to file COS immediately when she left the job, do it NOW. Yes she can stay in US during her COS is processing.

On legal status as long as a COS is timely filed.

Status will be H4 under process.

No. When an H1 ends, there is a 10 day grace period.
