The I140 filed by his previous employer was approved in 2007 and our priority date is finally "current" in the August 2015 visa bulletin. However, we just found out that the new employer hasn't done anything on our green card and merely transferred H1 & H4 Visa (worth mentioning that although they promised GC sponsorship, they're a startup and they didn't hire a good immigration attorney) Now that we're current, can we go ahead and file I485 for adjustment of status with the approved I-140 filed by previous employer OR should the new employer restart the PERM process all over?
