Sunny19 Posted May 11, 2015 Report Posted May 11, 2015 Hi, I came to US as a dependent on H4 and went back to India recently. During my stay in US, I was harassed and physically abused by my husband. My husband is not responding, when I ask about my visa status. I want to come back to US to stay with my extended family for few days, and I am not sure if I can apply for visitor visa when I am not sure about my H4 status. Looking forward for suggestions on this case. Thanks in advance.
jairichi Posted May 11, 2015 Report Posted May 11, 2015 Your husband can no way revoke your H4 visa. To enter US you will need a valid H4 visa and a copy of your spouse's I797. Since you do not have that you can apply for a B2 visa. No issue with that.
pontevecchio Posted May 11, 2015 Report Posted May 11, 2015 It will be much more helpful if you discuss specifics with the firm of Murthy. If he is in valid H1 status then you can enter on the basis of the H4 visa. You can apply for a tourist visa which under the circumstances may be difficult. Whatever you do first run it by a Lawyer.
