Travelling to India- I'm on OPT_Ext and H1b in process-Emergency

Hi

 

Currently I'm on POT-Extension expiring oct-2015, Visa Expired and applied for H1b Regular.

 

My situation is very Urgent..Can you please suggest me on this situation.

 

Can i travel to India in this situation or would it be an risk to travel India while H1b in processing and  visa Expired and OPT_Ext getting expired(Oct-2015)?

You would need a F1 VISA to come back. If your H1 petition is approved then you can come back with the H1 visa up to 10 days before the start. Hence a definite risk .
