umjain2007 Posted March 25, 2015 Report Share Posted March 25, 2015 Hello Friends, My issue is pretty straighforward. I stayed in United States for 7 years on L1 visa. . I returned from United States on 11th April 2014 (5 days before my Visa expiration date) to return back to India. Can I apply my H1 Visa this year i.e 1st April 2015 (11 days short of 1 year) ? Anyone know if I need to complete one year before I file H1 or before reentering USA. Any prompt help will be highly appreciated. There is a lot of money involved in my H1 processing and there is no point in going ahead if I am not even elligible this year. Kind Regards, umjain Link to comment

jairichi Posted March 25, 2015 Report Share Posted March 25, 2015 Only on 11th April 2015 you are eligible to apply for a cap subject H1B petition. If USCIS has stopped accepting applications by then only next year. Link to comment
