Travel on H4 and return while H1 B is processed

Hi,

 

I am currently on H4 visa. I am planning to make a trip to India on March 20th. I may return only on May 25th. My husband is planning to apply H1 B for me this year.

Will there by any problem returning back if

 

a) I dont get picked in the lottery and I return on H4 visa?

b) If it gets picked, but, the status is still under processing / RFE etc.?

c) if gets approved and I still return on my current H4 stamping?

 

Kindly help me as soon as possible.

Do you mean you will have a company filing your H1 ?

c. No

 

I assume the idea of H1 visa stamping is fine with you.

c. No. You can move to H1B status either with H1B visa or employer files for COS.
