While in US on B1 an employer can file a H1B petition for you. But, once your period of stay on B1 expires you need to exit US. Later with an approved H1B visa and I797 you can enter US. pontevecchio Posted November 13, 2014 Report Share Posted November 13, 2014 You gave the impression that you wanted to change status here after coming over on a B1 or B2 ? visa and usually and generally you will need to leave and get the appropriate visa and then return at the appropriate time. You will not get a B1 extension unless you have very specific reason for USCIS to approve. If you leave after B1 ext denial your B1 visa is automatically void. Link to comment
