adeelx Posted November 11, 2014 Report Share Posted November 11, 2014 Hi i received my green card last month via EB2 category.it took me almost 2 years to get employment based GC. now my employer is threatning me that i have to work for him for atleast 6 months or else he will revoke my GC. this threat is stopping me to take some good job offer and i am also scared that my employer will do something bad with my GC.right now my employer is taking 50% commision from my actual contract with my client. can you guide me what to do ? what are my rights on GC ? can a work for any other employer / company ? please guide me i am looking for expert opinion Link to comment
JoeF Posted November 11, 2014 Report Share Posted November 11, 2014 There is no specific limit to change jobs. But, at the time of getting the GC, you have to have the intent to work for the sponsoring employer "indefinitely." That doesn't mean forever, it just means that you don't have the intent to change jobs. The normal rule of thumb is to wait for at least 6 months before changing jobs. Having said that, an employer threatening you is a perfectly valid reason to quit the job immediately. If you have that threat in writing, there isn't much the employer can do. Link to comment
pontevecchio Posted November 11, 2014 Report Share Posted November 11, 2014 You need to discuss the matter with a Lawyer. Talk to the firm of Murthy. They will guide you appropriately. The employer cannot revoke the GC because he will be held responsible for fraud if he does that. Link to comment
