Apply H1 B Visa Application while iun US on B1

Hello everyone,

I am planning on visiting US on B1 end of December 2014.. However my company is filing for my H1b in April 2015. I will be in the US at that time. Can my employer file for H1 b while I am on B1 visa in US.

Note: If I get my H1 b approved, I am planning on going back to India before my 6 months period in B1 expires and get my H1b stamped and come back in October 2015.

My only question here is that, I want to know if my employer can apply for H1b while I'm in US on B1 visa and if there are any chances that it might get rejected because I'm in US while applying.
