My employer B has filed my AOS petition during H1B transfer and asking me not to leave the country. I have an valid I-797 from my current employer 'A'. I am intending to travel to INDIA for some personal reasons and coming back in 3 weeks. Can i travel to INDIA on my current 'A' employer I-797 and renter USA or I need to wait for my petition to be approved before leaving to INDIA ? FYI -- I haven't yet resign or etc... Link to comment

pontevecchio Posted November 3, 2014 Report Share Posted November 3, 2014 AOS = Adjustment of status in the context of a GC. Neither AOS nor COS applies to your situation. You need the H1 petition approval from, B to come back and work for them. Link to comment
