ptry Posted October 21, 2014 Report Share Posted October 21, 2014 Hi, Right now I am in India and I have already completed my 6 years of H1b and I have an approved I140 through my previous employer which is still valid. Now I am thinking for a new H1 with a different company. So do I need to go through the H1 lottery processing again on April 2015, Or can I apply for a new H1 anytime soon Thanks Link to comment

itsmeusa Posted October 22, 2014 Report Share Posted October 22, 2014 You are cap exempt (no need to undergo lottery process) if your I-140 is still approved, you can use the same and prospective employer could ask USCIS to give you 3 years of extension. Link to comment
