H1 Clock reset after one year

Hi

I was in USA for around 3 years on L1B and retured back to my country on 20th of Oct 2013 since L1B was exprining on 24th Oct 2013. Now my company appied H1 under Cap, also I got approval email for H1. My question is if I get stamped before Oct 2014 and I travell to USA after 20th of Oct 2014 will my US stay clock reset to 6 years for new H1. Please clarify.

The total for the L1 and H1 will be 6 years. The way the H1 period resets is to leave the country for one year and THEN get a cap subject H1 approved. If the company had applied for next year you would retain the H1 6 years.

Clock will reset only if a cap subject H1B petition was filed after 1 year stay outside US. Date of entry does not matter. Your clock did not reset.

It would have reset only if you had been abroad for a year when the H1 was FILED.
