applying for h4 while not on job

husband worked on senior positions. however he is not in  job for last couple of months. applying for h4 now.  will it be a problem?

what kind of questions would be asked? what kind of documents to be shown.

Was he getting paid by his employer? If not then he's going to have serious problems as he's out if status!!!

If your spouse is in US he is out of status from the last day of his job. His COS to H4 will not be approved. He has to exit and enter with a valid H4 visa and a copy of your I797.

If he is out of status, a COS is unlikely to be approved.

I would rephrase the question.

 

wife h1 got 2 months back, not travelled till now. kid h4 done along with primary applicant.

 

husband had b1, travelled twice for short term. not in US at present.

 

now we want to apply for h4 for husband.

 

what kind of questions would be asked? what kind of documents to be shown.

as we didnt apply for his h4 together.

You need a copy of your spouse's I797.

No specific questions except about the H1 job and her plans. Documents are as per the consulate site . The fact that the H4 applicant has no job is IMMATERIAL.
