ArjunReddy9 Posted March 1, 2014 Report Share Posted March 1, 2014 Hi Everybody, My h1b (6 years) is expiring next year on August 2015 and I already have my GC EB2 I-140 approved (Priority date Jun 2012). Can I still remain in legal status and work in the U.S after it’s expired? Or do I have to file my I-485 before it expires. Can someone shed more details into it please? Thanks Link to comment

Thanks Employer can file for 3 year extensions based on approved I-140. Link to comment
pontevecchio Posted March 1, 2014 Report Share Posted March 1, 2014 Based on an approved I-140 you are eligible for 3 year H1 extensions beyond the initial 6. I am puzzled why you are not aware of this. Link to comment
