pontevecchio Posted February 24, 2014 Report Share Posted February 24, 2014 797 refers to a notice. If you mean you had an H1 petition approved in 2008 then that petition is useless. You have been cap counted. You can get a new employer to file possibly a non cap H1 and on approval get the visa and come over to start. Link to comment
