H1B Expired > Blanket L1B > Back In India > Old H1B Cap Exempt?

Hi,

 

I had a H1B visa [2006] year, valid till Apr 2009 from Company A.. I was in USA between Sep-2007 and Mar-2009.

then I went back to India, worked in offshore for 7 months, applied for Blanket L1B, approved.. and was in USA between Nov-2009 and Apr-2013...

 

I believe I have stayed in USA for around 5yrs.. which is L1B cap.. for me to move back to India. 

 

Just wondering if I can apply for H1B Cap Exempt... and possible employer transfer with the OLD H1B.

 

NOTE: H1B was stamped in my OLD passport.. and the passport is marked as cancelled as I have the new passport after marriage with spouse endorsement, and L1B.

 

Any feedback?

That does not seem possible. But you can use your contacts to have an employer file the H1 in April the day after you finish 365 days away for a start in October.
