What visa will you try for during your visit? You are aware that a complaint to the DOL before the H1 employer terminates you in writing and also revokes the H1 will result in possible back pay and a return to a more legal status for you>? Will there be issues while stamping ?Please help. Was your H1B petition was approved as COS? If yes and if you had reported to employer and not being paid you are out of status. Without a job there is no possibility of getting a stamping. Link to comment

Will there be issues while stamping ?Please help. VISA stamp?? H4 or H1?? If it is H1 then you need latest pay stubs for visa stamp. If you H1 was approved with COS then you are currently on H1 and you need to get paid every month. Link to comment

t75 Posted February 24, 2014 Report Share Posted February 24, 2014 Do you have paychecks? If not, you are out of status and SHOULD be denied stamping for H1B. Follow the rules for the program or don't bother coming back claiming you are working. Link to comment
