binu.sale
I'm currently on L1 and my employer pay full Indian salary and per diem. We do not get any US payslips here. Can I go for L1 to H1 without US payslips ? Link to comment

JoeF
On L1, you need to get paid in the US. Per diem is not a salary. Your employer seems to be breaking the law. Link to comment
pontevecchio
The prevailing wage concept does not apply to L1. A sum of money sufficient to avoid invoking state aid is allowed. The OP needs to ask his/her Immigration section about the H1. Link to comment
binu.sale
I cannot ask my present employer about H1 related clarifications..I have Indian payslips and expense reports which mention per diem and apartment rent etc. Will that be sufficient for a L1 to H1 COS ? Or do I need to changefrom COS to consular processing ? Link to comment

Or do I need to changefrom COS to consular processing ? Currently you are illegal. If you do not act now, you will be in more trouble in future and of course your H1 will not be approved for be illegal in US. On L1, you need to get paid in US curreny. Link to comment
pontevecchio
You need to ask the Immigration Lawyer for the company filing the H1 if you have queries. You are fine contrary to the drum beat of responses. You did say you had a Lawyer give you advise in one of your many threads. That is absolutely true. A foreign entity can pay a person in L1 wherever they choose subject to tax ramifications. Link to comment
binu.sale
is there any extra documentation needed other than Indian payslips? does it trigger an RFE ? Link to comment
pontevecchio
The L1 approval and the I94 are enough. Why are you getting so involved in the matter rather than letting the employer file. Worst case the H1 visa. Link to comment
