H1 Visa renewal outside US

Hi,

 

  I am currently working in India, Bangalore. I have H1 Visa petitioned by my previous employer valid till (May 31, 2014). I am looking for opportunity in USA. Fortunately, one consultancy (SAP based service company - www.tpcus.com) came up to file for H1 renewal and gave me a job offer. The consultancy company said my visa extension is under process.

 

1. After i get, Extention notice (I-797), i must schedule for visa interview. So what will be my expiry of new visa that will be stamped?

2. Should i need to travel to US before May 31, 2014 (as per expiry date of current visa) ?

3. If i get an extention for another 2 years, my new I797 and new H1 visa will reflect the same new expiry date?

 1. What is difference between filing new H1 petition and extending H1 petition?

 2. I know , a new H1 petition should be done on april of every month based on quota system. So

     H1 Extension should also be done on April or it can be done on any month?

 3. Does H1 extension go through quota system?

1. Both are same. H1B extension petition is nothing but a new H1B petition but it is cap exempt and therefore can be applied anytime.

2. H1B extension can be done anytime and on approval one can join immediately.

1. No difference. H1 extension is a non cap subject H1 and a cap H1 is a cap subject H1 when one is applying for the first time. Once capped every change of employer needs a new non cap H1 petition approved.

2. You mean April, every year. See 1.

3. No. See 1. Once cap counted you are eligible for a total of 6 years in H1 status which is defined as working with a H1 I94 in the USA.
