My entry is going to be expired in April while I have 5 years of multiple visa. My company is applying for H1B from April which means I will be getting it in September this year. My question is do I have to leave the country anyway since my I-94 will be expired or if my H1B is requested in April, can I stay in US till I get my H1B done. Please Advice, Hasan Link to comment

Please Advice, Hasan Yes, you need to exit US and once H1B petition is approved enter with a valid H1B visa and new I797 10 days before your employment start date. Link to comment
pontevecchio Posted February 10, 2014 Report Share Posted February 10, 2014 If you overstay your B2 I94 your visa will be invalid for further use. Leave before the I94 expires and if the H1 petition is approved get a H1 visa and come over up to 10 days before October,1 or the start date. Link to comment
