JoeF
You are out of status, i.e., illegal, since Jan. 17. There is NO grace period on H1! You need to discuss your situation with a good immigration lawyer. You very likely have to leave the country immediately. Link to comment

raja_81
Thanks for the responses However ,i got a job offer in a company. They already have a LCA and will be filing my H1 next week (Feb 1st week) with Jan 17th pay slip. What are the chances of approval of H1 without RFE or CP? Will it make any difference if the filing is done in normal or premium ? Thanks, Raja Link to comment
pontevecchio
YMMV. Wait for the result. Link to comment

You will get consular processing as you are out of status. Yes, it makes a difference if you file by premium as you will get a decision in 15 calendar days. Link to comment
JoeF
Premium or not doesn't make any difference. USCIS may approve it with EOS, but there is no guarantee. In recent times, they have become stricter. Link to comment
