This happened 5 years back. How do we know whether their visa is also cancelled or not? The visa stamping in their passport is valid till 2015. They want to visit us this summer. Please help. Thanks. But in their case the I-94 period did get over but there were waiting for the extension request notice. The moment the rejection letter came from USCIS they left. So the visa still remains cancelled? But, as soon as it was denied, if they were here past the original I-94 date, the visa became invalid. Link to comment
pontevecchio Posted January 28, 2014 Report Share Posted January 28, 2014 Yes. If you overstay the I94 the visa gets cancelled. Have them get a new visa. The overstay will usually not matter. Trying to save money when the bottom line is your parents being sent back from the Airport is unwise. Have them get a new visa. Link to comment
